1) Who We Are

Tow.market (“Tow.market,” “we,” “us,” “our”) provides a technology platform that connects users with tow operators, fleets, and related service providers. Tow.market does not itself provide towing services unless explicitly stated.

2) Eligibility & Accounts

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services.
• You agree to provide accurate information and maintain the security of your account credentials.
• You are responsible for all activity that occurs under your account.

3) The Services

Tow.market enables users to request towing and related services, receive ETA updates, track service progress, and make payments through the platform. Tow.market may also support vehicle disposal/junk pickup workflows and insurance-initiated requests where applicable.

AI & automated decisioning

Tow.market may use automated systems (including AI) to assist with routing, equipment matching, ETA estimates, and fraud detection. These systems are designed to improve reliability and reduce failed dispatch.

4) Requests, Dispatch, and Completion

• Request accuracy: You agree to provide accurate pickup location, vehicle details, and issue information.
• Dispatch: Operators may accept or decline requests. Availability is not guaranteed.
• On-site changes: If conditions differ from what was provided, pricing and equipment needs may change.
• Completion: A job is considered complete when the operator marks it complete and/or delivery is confirmed.

5) Pricing, Payments, and Payouts

Tow.market may present estimated pricing before you confirm a request. Final pricing may vary due to distance, vehicle condition, access limitations, equipment requirements, wait time, tolls, storage, or other factors.

Consumer-paid jobs

• For consumer-paid jobs, you authorize Tow.market (and its payment processors) to charge your payment method.
• Tow.market may use escrow-like holds and release payouts to operators after completion and confirmation.
• Tips (if enabled) are optional and may be processed through the platform.

Insurance-initiated jobs

• For insurance or third-party billed jobs, your insurer or authorized partner may be responsible for payment.
• You may be responsible for uncovered services, out-of-policy requests, storage, or fees not covered by your plan.

Tow.market does not store full payment card numbers. Payment processing is handled by third-party payment providers.

6) Cancellations & No-Shows

Cancellation and no-show fees may apply to help compensate operators for time and travel. Exact fees may vary by location, operator, and job type, and will be shown to you when applicable.

• Before dispatch: you may be able to cancel at no charge.
• After dispatch: a cancellation fee may apply if the operator is en route or on-site.
• No-show: if you are not available or cannot provide access, additional fees may apply.

7) User Conduct

• Do not use the Services for unlawful purposes or to interfere with operations.
• Do not harass, threaten, or discriminate against operators, staff, or other users.
• Do not provide false information or attempt to bypass platform payment or dispatch.
• Follow safety instructions and local laws, especially at accident scenes or hazardous conditions.

8) Operator Terms (Additional)

Tow operators and fleets may be subject to additional agreements, onboarding requirements, licensing verification, and performance standards. Operators are responsible for complying with applicable laws, licensing, insurance, equipment rules, and safe towing practices.

9) Reviews, Ratings, and Feedback

Tow.market may allow users to submit ratings and reviews. You agree that your reviews are truthful and do not contain unlawful, defamatory, or abusive content. Tow.market may remove or moderate content at its discretion.

10) Disputes & Chargebacks

If you believe there is an issue with a charge or a service, contact Tow.market support promptly. We may investigate disputes, request additional details, and attempt resolution. Excessive chargebacks or fraud may result in account suspension.

11) Disclaimers

The Services are provided on an “as is” and “as available” basis. Tow.market does not guarantee uninterrupted access, operator availability, or specific outcomes. Actual towing is performed by independent operators and may be affected by traffic, weather, access, safety concerns, or local restrictions.

12) Limitation of Liability

To the maximum extent permitted by law, Tow.market and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from or related to your use of the Services.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13) Indemnification

You agree to indemnify and hold harmless Tow.market and its affiliates from claims, liabilities, damages, and expenses arising out of your use of the Services, your violation of these Terms, or your violation of any law or third-party rights.

14) Termination

We may suspend or terminate access to the Services if you violate these Terms, engage in fraud, or create risk for Tow.market, users, operators, or the public. You may stop using the Services at any time.

15) Changes to the Services or Terms

We may update the Services and these Terms from time to time. We will post updated Terms with a revised “Last Updated” date. If changes are material, we may provide additional notice as required by law.

16) Governing Law
